Aren\u2019t they the same thing? Well, not exactly. myLIFE is here to explain what you can bequeath and donate, to whom, and how much it might cost.<\/p>\n<p>In the case of both a bequest and a donation, an asset (or a right) is voluntarily transferred to one or more people. The main difference is that a donation is between living persons while a bequest comes about because of a death.<\/p>\n<p>In other words, the person receiving a donation (the <strong>beneficiary<\/strong>) gets it immediately during the lifetime of the <strong>donor<\/strong> without the need for a special procedure. The terms <strong>donation<\/strong> and <strong>gift<\/strong> are synonymous, in particular when the donation is being formally documented by a notary. Conversely, a <strong>bequest<\/strong> is a measure contained in a will and takes effect after the death of the <strong>testator<\/strong> (the person making the bequest). In this case, the beneficiary is known as the<strong> legatee<\/strong>.<\/p>\n<p>It should be remembered that different rules apply depending on the nature of the transferral. Let us explain.<\/p>\n<h2 id=\"h2_0\" >Gifts\/donations<\/h2>\n<p><span style=\"text-decoration: underline;\">What can be donated and to whom<\/span>?<\/p>\n<p>A donation can be made to natural persons (children, spouses, parents, etc.) or legal entities (associations, charities, etc.) and may concern:<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><strong>movable property<\/strong>: car, shares in companies, jewellery, money, etc.;<\/li>\n<li><strong>immovable property<\/strong>: house, apartment, land, etc.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>It is also possible to donate just <a href=\"https:\/\/my-life.lu\/en\/usufruct-whosafruct-41005\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"text-decoration: underline;\"><strong>the bare ownership or the usufruct<\/strong><\/span><\/a> of a movable or immovable property. This means that the donor transfers either the ownership of the asset (bare ownership) or the right to use it (usufruct).<\/p>\n<p><span style=\"text-decoration: underline;\">Is a notary required to make a donation<\/span>?<\/p>\n<p>The Luxembourg Civil Code states that, in order to be valid and incontestable, a donation should in theory pass before a notary. There are, however, certain exceptions that have long been recognised in case law, notably <a href=\"https:\/\/my-life.lu\/en\/can-gifts-be-tax-efficient-for-passing-on-assets-40007\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"text-decoration: underline;\"><strong>gifts by hand<\/strong><\/span><\/a>\u00a0and indirect gifts:<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>a <strong>gift by hand<\/strong> means that the donor simply hands an item of movable property over to the beneficiary;<\/li>\n<li>an <strong>indirect donation<\/strong> is a donation that takes place via a circuitous route, i.e. a neutral act where the donative intent is not ostensibly expressed (e.g. a bank transfer).<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>In such cases, there is no requirement for formal documentation, but any person wishing to prove the existence of the donation and its date must be able to produce written evidence (record of delivery of letter of intent or thanks, bank statement, etc.).<\/p>\n<p>In the case of immovable property, however, a formal document drafted by a notary is required, unless the asset is located outside Luxembourg. In such cases, the applicable rules are those in force in the country where the asset is located.<\/p>\n<p><span style=\"text-decoration: underline;\">How much does a donation cost<\/span>?<\/p>\n<p>There are often fees that must be paid in the event of a donation. While the beneficiary tends to incur these fees, the notarised act may also specify that the charges be partially or wholly borne by the donor.<\/p>\n<blockquote><p>If the donation concerns immovable property located abroad, there is no stamp duty to pay in Luxembourg; the asset is subject to the donation laws of the country where it is located.<\/p><\/blockquote>\n<p><strong>=&gt; <em>Stamp duty<\/em><\/strong>: This varies depending on the relation between the donor and the beneficiary, as well as the value of the asset.<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>Stamp duty ranges from <a href=\"https:\/\/my-life.lu\/en\/can-gifts-be-tax-efficient-for-passing-on-assets-40007\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"text-decoration: underline;\"><strong>1.8% (direct descendants) to 14.4% (no family relation)<\/strong><\/span><\/a>.<\/li>\n<li>It is 4.8% for donations to charities, certain public bodies and not-for-profit organisations and foundations.<\/li>\n<li>Stamp duty is halved for wedding gifts or gifts included in a marriage contract.<\/li>\n<li class=\"li1\">Lastly, there is no stamp duty on donations to foundations made to establish scholarship funds at universities and public educational institutions, or for direct or indirect donations that are not subject to registration.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>If the donation concerns immovable property located abroad, there is no stamp duty to pay in Luxembourg; the asset is subject to the donation laws of the country where it is located.<\/p>\n<p><strong>=&gt;<\/strong> <em><strong>Notary fees<\/strong><\/em>: These vary according to the value of the asset.<\/p>\n<p><strong>=&gt;<\/strong> <em><strong>Transcription fees<\/strong><\/em>: These are payable on immovable property located in Luxembourg and represent 1% of the property\u2019s fair value.<\/p>\n<p><strong>=&gt;<\/strong> <em><strong>Municipal administration tax<\/strong><\/em>: This must be paid on immovable property located in Luxembourg City. It is 50% of the stamp duty and does not apply to single-family houses, apartment buildings, etc.<\/p>\n<p>In the event of donation of bare ownership, stamp duty is payable only on <a href=\"https:\/\/my-life.lu\/en\/usufruct-whosafruct-41005\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"text-decoration: underline;\"><strong>a percentage of the fair value of the asset<\/strong><\/span><\/a>, which varies depending on the age of the beneficiary upon receipt of the donation.<\/p>\n<p><span style=\"text-decoration: underline;\">Tax deductions<\/span><\/p>\n<p>Under certain conditions, gifts and donations are tax deductible in Luxembourg. This concerns cash donations given to <a href=\"http:\/\/www.impotsdirects.public.lu\/fr\/az\/l\/libera_dons.html#\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"text-decoration: underline;\"><strong>recognised public-interest foundations and organisations<\/strong><\/span><\/a> but also donations in cash and in kind given to the National Culture Fund and to cultural institutions and organisations.<\/p>\n<p>To be eligible, you must either be a Luxembourg resident and submit a tax return or annual statement; or be a non-resident and submit a tax return with <a href=\"http:\/\/www.impotsdirects.public.lu\/fr\/az\/a\/assimil.html\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"text-decoration: underline;\"><strong>assimilated resident status<\/strong><\/span><\/a>. Total annual donations* must be at least \u20ac120 and the annual deduction cannot exceed 20% of the taxpayer\u2019s net income or \u20ac1,000,000. If this ceiling is breached, the donations may be carried over to the next two tax years.<\/p>\n<h2 id=\"h2_1\" >Bequests<\/h2>\n<p><span style=\"text-decoration: underline;\">What can be bequeathed<\/span>?<\/p>\n<p>Just like with a donation, movable and immovable property can be bequeathed. However, it is incumbent upon the testator to define the assets that are part of their estate and that they are entitled to transfer.<\/p>\n<p><strong>If the testator is not married<\/strong>:<br \/>\nThe estate consists of all their assets, minus their debts.<\/p>\n<p><strong>If the testator is married<\/strong>:<br \/>\nThey must draw up a list of assets to be divided up (<a href=\"https:\/\/my-life.lu\/en\/estate-planning-liquidation-of-matrimonial-property-40003\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"text-decoration: underline;\"><strong>liquidate the matrimonial regime<\/strong><\/span><\/a>): those that actually belong to the testator and those which are common property. This depends on the matrimonial regime that was chosen at the time of the marriage:<\/p>\n<ul>\n<li><strong>Statutory community of property regime<\/strong>: Shared property (everything acquired during the marriage) is divided equally. One half is retained by the surviving spouse and the other half becomes part of the estate. This other half is added to the testator\u2019s own assets (those purchased prior to the marriage or received during the marriage by donation or inheritance, and personal property such as clothes, degree certificates, property rights, etc.).<\/li>\n<\/ul>\n<table style=\"border-collapse: collapse; width: 100%;\" border=\"1\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\">Estate = (shared property \/ 2) + own assets<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<ul>\n<li><strong>Universal community of property regime<\/strong>: Shared property (everything acquired before and during the marriage, except assets that are personal to each individual) is divided equally. One half is retained by the surviving spouse and the other half becomes part of the estate.<\/li>\n<\/ul>\n<table style=\"border-collapse: collapse; width: 100%;\" border=\"1\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\">Estate = shared property \/ 2<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<ul>\n<li><strong>Separate property regime<\/strong>: There is no shared property, only personal assets.<\/li>\n<\/ul>\n<table style=\"border-collapse: collapse; width: 100%;\" border=\"1\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\">Estate = own assets.<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>If no choice was made at the time of marriage, the default regime is that of statutory community of property.<\/p>\n<blockquote><p>A portion of the estate must go to the children, who are entitled to a compulsory share (this is known as the \u2018reserve\u2019). The surviving spouse, meanwhile, is entitled to inheritance rights as provided for by law.<\/p><\/blockquote>\n<p><span style=\"text-decoration: underline;\">To whom can you make a bequest<\/span>?<\/p>\n<p>Once again, the testator cannot simply do as they please. The law dictates that there are compulsory heirs, i.e. persons who are legally entitled to part of the estate.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-7999\" src=\"https:\/\/my-life.lu\/wp-content\/uploads\/2018\/11\/Article_40008_02.jpg\" alt=\"\" width=\"863\" height=\"575\" srcset=\"https:\/\/my-life.lu\/wp-content\/uploads\/2018\/11\/Article_40008_02.jpg 7000w, https:\/\/my-life.lu\/wp-content\/uploads\/2018\/11\/Article_40008_02-300x200.jpg 300w, https:\/\/my-life.lu\/wp-content\/uploads\/2018\/11\/Article_40008_02-768x512.jpg 768w, https:\/\/my-life.lu\/wp-content\/uploads\/2018\/11\/Article_40008_02-1024x683.jpg 1024w, https:\/\/my-life.lu\/wp-content\/uploads\/2018\/11\/Article_40008_02-1080x720.jpg 1080w, https:\/\/my-life.lu\/wp-content\/uploads\/2018\/11\/Article_40008_02-395x262.jpg 395w\" sizes=\"(max-width: 767px) 89vw, (max-width: 1000px) 54vw, (max-width: 1071px) 543px, 580px\" \/><\/p>\n<p>As such, some of the assets must be transferred to children, who are compulsory heirs (read about the order of inheritance in <a href=\"https:\/\/my-life.lu\/en\/who-inherits-what-in-the-event-of-your-death-40005\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"text-decoration: underline;\"><strong>Inheritance: who gets what?<\/strong><\/span><\/a>). The estate may therefore comprise only the remaining assets (the available portion). If there are no compulsory heirs, the testator is free to divide up all their assets.<\/p>\n<p><span style=\"text-decoration: underline;\">How much does a bequest cost<\/span>?<\/p>\n<p>In the case of inheritance, unless specified otherwise in the notarised deed, the legatees must pay fees on the property they inherit. There are two types of tax: inheritance tax and transfer tax on death.<\/p>\n<p><strong>=&gt;<\/strong> <em><strong>Inheritance tax<\/strong><\/em>: This is payable if the deceased lived in Luxembourg and is calculated on the value of all movable property (located in Luxembourg and abroad) and immovable property (only that located in Luxembourg), less debts and funeral costs. It varies according to the relationship between the testator and the legatee, but also according to the value of the estate assets.<\/p>\n<p>First, you should be aware that there are two different rates:<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>one on the reserved portion (i.e. the part to which the heir is legally entitled, known as ab\u00a0intestato inheritance);<\/li>\n<li>a second one on the unreserved portion (i.e. the part bequeathed according to the will).<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>These rates vary from 0% to 15%. In addition, the base rate is increased according to the net taxable amount of the portion bequeathed, provided it is more than \u20ac10,000. <a href=\"https:\/\/pfi.public.lu\/fr\/citoyen\/successions\/tarif.html\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"text-decoration: underline;\"><strong>See here for a breakdown of the rates and increases applied for inheritance tax<\/strong><\/span><\/a>.<\/p>\n<p>There are, however, situations where no inheritance tax is payable, including:<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>on assets inherited by direct ancestors\/descendants (parents, grandparents and children, except on the unreserved portion in the case of the latter);<\/li>\n<li>on assets between spouses or partners who have been in a registered partnership for at least three years and which has not been dissolved at the time of death;<\/li>\n<li>on real estate located outside Luxembourg;<\/li>\n<li>if the estate is worth \u20ac1,250 or less.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><strong>=&gt;<\/strong> <em><strong>Transfer tax on death<\/strong><\/em>: This is payable if the most recent residence of the deceased is not in Luxembourg. It is calculated only on immovable property located in Luxembourg.
