A few weeks ago, he was deciding whether to <a href=\"https:\/\/my-life.lu\/en\/starting-a-company-limited-liability-company-or-sole-proprietorship-20011\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"text-decoration: underline;\"><strong>create a commercial company such as a SARL, or become self-employed as a sole trader<\/strong><\/span><\/a>. After weighing up the pros and cons of each, he decided to go for the second option, which was better suited to the nature of his business.<\/p>\n<p>His wife, C\u00e9line, is helping him a lot on this new venture. She keeps the books, updates his website, organises his meetings and schedule, and so on. She\u2019s a key part of the business and the work she does for her husband is essentially a full-time job.<\/p>\n<p>Although C\u00e9line can\u2019t be hired as an employee, her professional status is still recognised and she may be able to register as an assisting spouse, meaning she\u2019ll be covered by Luxembourg social security and pay into her pension. So, does she fulfil the requisite conditions?<\/p>\n<blockquote><p>If C\u00e9line had another job or assisted Tom on an ad-hoc or temporary basis, she wouldn\u2019t be able to register as an assisting spouse.<\/p><\/blockquote>\n<h2 id=\"h2_0\" >What are the eligibility conditions?<\/h2>\n<p>According to <a href=\"https:\/\/ccss.public.lu\/en.html\" target=\"_blank\" rel=\"noopener\"><span style=\"text-decoration: underline;\"><strong>Luxembourg\u2019s joint social security centre (Centre commun de la s\u00e9curit\u00e9 sociale \u2013 CCSS)<\/strong><\/span><\/a>, it is compulsory for a spouse to register as an assisting spouse if they meet the following conditions:<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>They are over 18.<\/li>\n<li>The assistant and the primary insured person are married or in a civil partnership.<\/li>\n<li>The assistant\u2019s work is \u201cup to a level that implies that these services are to be considered as a main activity\u201d, i.e. they can\u2019t register if they only work part-time.<\/li>\n<li>The primary insured person is registered as a self-employed worker in their own name to carry out this work as their main activity.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>C\u00e9line and Tom are married, he is registered as a self-employed worker in his own name and she works for him on a full-time basis, meaning that she fulfils these conditions.<\/p>\n<p>If C\u00e9line had another job or assisted Tom on an ad-hoc or temporary basis, she wouldn\u2019t be able to register as an assisting spouse. Likewise, she wouldn\u2019t be eligible for assisting spouse status if Tom were self-employed in a company structure, but would be able to register as an <a href=\"https:\/\/ccss.public.lu\/fr\/particuliers\/salaries\/travailler-secteur-prive.html#bloub-0\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"text-decoration: underline;\"><strong>employee<\/strong><\/span><\/a>.<\/p>\n<blockquote><p>National pension insurance contributions are compulsory if you are registered as an assisting spouse.<\/p><\/blockquote>\n<h2 id=\"h2_1\" >How to register as an assisting spouse<\/h2>\n<p>C\u00e9line can now register for social security in Luxembourg. As an assisting spouse, she\u2019ll be covered in the event of illness, maternity leave, a work accident, work-related illness, disability or dependency, and she\u2019ll pay into her pension.<\/p>\n<p>To register, she must send a declaration form for assisting spouses or partners (<em>d\u00e9claration d\u2019entr\u00e9e pour conjoint-aidant ou partenaire<\/em>) <strong>to the CCSS at the following address<\/strong>:<\/p>\n<p><em>Centre commun de la s\u00e9curit\u00e9 sociale<\/em><br \/>\n<em>L-2975 Luxembourg<\/em><\/p>\n<p><span style=\"text-decoration: underline;\"><strong>Contributions<\/strong><\/span>: Once C\u00e9line has registered, Tom must pay social security contributions for her to the CCSS. These will be calculated on the basis of Tom\u2019s business profits. The couple\u2019s social security contributions will be halved, but C\u00e9line\u2019s contributions must not exceed double the minimum wage, i.e. \u20ac5,407.48 (minimum wage = \u20ac2,703.74* x 2).<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>Pensions<\/strong><\/span>: National pension insurance contributions are compulsory if you are registered as an assisting spouse. This means that contributions paid during this period will be taken into account when calculating C\u00e9line\u2019s pension entitlement.<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>Important<\/strong><\/span>: Assisting spouses are automatically registered with the <a href=\"https:\/\/www.mde.lu\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong><u>Employers\u2019 Mutual Insurance Scheme (<em>Mutualit\u00e9 des employeurs<\/em>)<\/u><\/strong><\/a> with the principal insured person. They are registered jointly and inseparably with the principal insured person. It allows them to cover themselves in the event of loss of income due to illness.<\/p>\n<h2 id=\"h2_2\" >Exemption from compulsory social security<\/h2>\n<p>Even if she fulfils the eligibility criteria as an assisting spouse, C\u00e9line may request to be exempted from social security contributions if she wishes. To do so, she must send an exemption form for assisting spouses or partners (demande de dispense pour conjoint-aidant ou partenaire) to the CCSS.<\/p>\n<p>But remember, if she does this C\u00e9line won\u2019t be covered by social security, which means that she wouldn\u2019t be entitled to any cash benefits in the event of illness, maternity leave or a work accident, and wouldn\u2019t be paying into her pension.<\/p>\n<p>Important: The CCSS does not accept back-dated applications, whether it\u2019s to register as an assisting spouse or apply for an exemption.
